Legal Question in Criminal Law in California
I ws convicted of pc476 on 4/25/07,pc 530.5a on 7/1/04, and pc487a on 9/22/04. i was sentenced to state prison on 06/2007 and released on 02/16/08. do i have to wait 5 or 7 years to file for a petition of rehabilitation? please advise. thank you

Actually, you must wait for 7 years after you have been discharged from parole. There is no way around the waiting period. If you went to state prison you must wait for 7 years after being discharged from parole. It is by statue and is therefore black letter law.
