Legal Question in Criminal Law in California

one year pending

It's been one year since my possessions were confisgated and my status has been pending further investigation ever since. I was arrested and charges were dropped. (child Molestation charges but they seemed intent on nailing me for possession of child porn) Is there anything i can do at this stage to get my stuff back and/or close the case? Does one year mean anything? I was told if i tried getting my stuff back i'd be charged with something, but i dunno what i'd be charged with.

Re: one year pending

One year would seem to be a good time mark to ask for your possessions back, if indeed all charges were dropped. On the other hand, sometimes it is better to let sleeping dogs lie. I guess your decision would be based on how valuable the confiscated items are and how badly you want them.

One problem would be if you were served notice of forfeiture at some point. If yes, you had 30 days to respond and if you did not you might have lost your right to claim the property.

Hope this helps. Feel free to contact me directly.
