Legal Question in Discrimination Law in California
Age Discrimination
Hello all. I am an 18 year old
working in a retail supervisor shift.
Although I am young, I do my job
better then most of the managers
(who are above me) and well above
all other employees. A couple of my
managers seem to discriminate me
because of my young age. Is this
ground to have disciplinary action
taken upon the managers and what
kind of evidence is needed usually.
Most of the things happening include
yelling, alternate work, embarrassment in front of other
employees and other general harassment. The company I work for
is a large clothing retail store with
over 1000 stores.

I could not agree more with Mr. Kirschbaum.
I certainly felt your intelligence as well as work ethic coming through your words, but, unfortunately this does not rise to the facts necessary to support an age discrimination case.
Also, I agree that you may be happier elsewhere.

You are to be commended for your work ethic. You will probably go far in your career but to do so, you'll need to recognize a workplace that appreciates what you have to offer and allows you to thrive. It sounds as though this is not one of those places.
Yelling and the other things you describe is not, generally, grounds for a discrimination case. It shows poor management practices. And our age discrimination laws do not protect persons under 40. I know that sounds unfair, but our legislators, in their wisdom, thought it best to protect us old geezers over 40, from you up and comers seeking to replace us.
About all you can do is attempt to handle your work issues discreetly and internally. If the company refuses to address the problem to your satisfaction, recognize this is not the right place for you and move on. You'll be better off for it in the long run.
