Legal Question in Discrimination Law in California

Americans with Disabilities Act

Are there court decisions that better define reasonable accomodatiion?

Is a center required to provide a professional American Sign Language interpreter, although the child care center staff have had classes in American Sign Language, to a three year old child. The parent wishes to enroll their child and is demanding this level of service. The cost of the child care is about $24 per day and the cost of providing the professional service is anticipated to cost about $300 a day. This also assumes that we can even find an interpreter.

Re: Americans with Disabilities Act

There are some court case but it is basically decided on a case by case basis. In your case it is hard to imagine a court ruling that it is a reasonable accomodatiion. If you were my client i would feel comfortable in advising you not to hire the interpreter.

ADA,Sign Language Interpreter at Childcare Center

How many people make up your staff?

Are you receiving any public funds?

How does your license read?

What are the rules and regulations the center must follow?

Some states do require extraordinary measures be taken to accommodate the handicapped. Is California one of those?

Soooo many questions.

Consult an attorney who specializes in Title IX, ADA, etcetera. Look in the Yellow Pages or call the local Bar association. Ask. You can lose nothing by making further inquiry. You might

even end up knowing a little more than you do now.

Good luck.
