running out of patience
I am currently employed with a local company. The owner of the company has made several comments about me. Not trusting me, taking my job duties away with no explaination. Not enrolling my family in the medical insurance. I feel so harassed at work, I do not want to even go anymore. Everyone at work has made comments regarding the owner not liking black people, and him always standing over me, and cannot produce any reason for the harassment. I feel as though I just want to quit, and file an EEOC charge. Should I quit first? File the claim first? I have about 3 witnesses to this abuse.

You should see an attorney. Put together a good chronology of events/persons involved, info stated and list of persons that might be of assist. Do not speak with these persons yourself. See attorney and ask him/her to direct you further.

Your case should be investigated first, before making a decision what course of action to take. Be prepared to cite specific examples of how you are treated differently from other employees, any inappropriate comments made by the owner and anything else that leads you to believe he is racist. Obtain a copy of the personnel policies and employee handbook and make sure you have the phone numbers of your witnesses because your attorney will want to speak with them before you take any kind of legal action.
Once all of the information is obtained and evaluated, an attorney can discuss with you the best option to follow, whether it be filing a complaint with the EEOC or DFEH, going to court or arbitration, or writing a demand letter.
Under no circumstances should you quit until seeking the advise of an experienced employment law attorney.
