Legal Question in DUI Law in California

In 2009 i was convicted of a d.u.i..did some jail time, did 5 years formal probation, did the 18 month school ten classes,and had my license suspended for two years. i never paid the reinstatement fee to get my license back. fast forward to march 2116 i received a ticket for no license due to a dui suspension and they want me to do jail time.my license was suspended for 2 years 6ix years ago. am i still screwed or what?

What happened to you unfortunately happens to many people - you think by doing the things required of you, your license is back to full status, but you didn't actually finish all the requirements by paying the reinstatement fee.

They likely charged you with 14601.2 - driving on a suspended license because of a DUI conviction. That comes with mandatory jail, an ignition interlock requirement and fines ...IF you are convicted of that section.

Instead - your focus should be to get an attorney that can represent you and either get this dismissed or get the DA to change the code section to one that does not have the jail and interlock requirements.

Getting your license reinstated immediately will be the best thing you can do at this moment. Then get an attorney.
