Legal Question in DUI Law in California

97 Conviction, 1st DUI, will new Ins. Co. see it, and can you remove it from emp

I understand that the law in CA has changed and that DUI's stay on a drivers record 10 years vs. 7 when I was convicted. It's the only DUI I've gotten and I am swiching Ins. Companies 8 years later.

I had an out of state license and took the DUI Course, but since I had a VA License and moved 6 mo. later (I was there temporarily) it was never picked up by my insurance.

Will CA have this on my record since the reporting period was 7 years when I got the conviction, or will it be on for 10 with the new law? Can you show this as a ''non-conviction'' for employers?

Thanks!

The statute of limitations, that is the increase from 7 years to 10 years will operate to extend the life of the conviction from 7 to 10 years. However, it will not revive a dead conviction. That is once the 7 tear period has run the new statute cannot reinstate prior conviction.
