2nd dui within 3 yr probation sentence
I live in California. I had a DUI back in Oct 2003 and now I just got a 2nd one this yr in November. I wrecked my car on the highway driving through Bakersfield, CA. I was driving late at night and feel asleep while I was driving. My bac at the accident was .09 and my bac at the police station was .10. What can i be looking at now?

You definitely need an attorney. A second offense requires a substantial jail sentence. Because you blood alcohol level increased from the scene to the police station you may have a valid rising blood alcohol defense. This defense requires an expert witness. Your license will automatically be suspended by the DMV unless you request a hearing in a timely manner. This time has probably passed.
