Legal Question in DUI Law in California
2nd offense dui
Is a DUI considered a 2nd offence in California if it is within 10 years? And is the 10 years from the time of arrest to arrest or 10 years from conviction date to next conviction date? I thought I read somewhere that the law read ''if convicted within 10 years of the last conviction'' it was considered a 2nd offence. Could you refer me to the legal wording of the law?

You can start with 23152 (a)(b) of the vehicle code. This will detail what a DUI is. Further research and you may come upon 23140, 23136, these code sections will help you begin your research.
