Legal Question in DUI Law in California
Possible Appeal to Jail Sentence for Violation of Probation?
My friend has a suspended license and is on probation for a DUI from 2002. He got stopped for having a broken tail light and was fined, had his car impounded for 30 days (paid a lot!), and was sentenced to 10 days in jail. He must go to jail in 2 days. Is there any way to make an emergency appeal or file any document so that he does not go to jail?
More background information:
He will lose his job over this and he completed all the steps for his DUI (community service, taking classes, paying fees), he just was unable to show valid proof of insurance and a CA license (he has a license from another state), which is probably why his license is still suspended after so many years.

There's nothing that can be done within two days. Your friend should have made arrangements with the county jail to serve his sentence on the weekends. A request for weekends takes on an average of 2-3 weeks to process and get the appropriate approval. Unfortunately it does not seem possible for your friend to dodge this bullet this late in the game.
