Legal Question in DUI Law in California

I was arrested for dui and blew a .14 and was released immediately about 30 mins later into the custody of my gf. I then took my truck to the store and was arrested in the parking lot after getting back into my truck and starting it. I am wondering if there is any way to get off on the second dui since I was released while still drunk and my truck wasn't towed. Is it possible that they will drop the second dui?

They might agree to drop it, but not because they released you while you were still drunk. Depending on the county, a prosecutor might consider dismissing one with a plea to the other.

Most likely, you are going to get charged with two separate DUI incidents.
