Legal Question in DUI Law in California
I bet this is a new one. Help??
I was arrested for a DUI way back on Feb.14th. They gave me a court date for a month later, and the Judge said they lost my paperwork~''missisng complaint''. He rescheduled me for 6 weeks later, and yesterday AGAIN the Judge said he had a ''missing complaint''. AGAIN he rescheduled me to show up July 27th!! How many times can they do this to me? Obviously, I hope they never find my paperwork, but my imediate delima is I have no drivers licence, and I have to work and drive for a living!! I'm really freeked out about getting pulled over.
The DMV says they need my conviction papers in order to send me to the manditory classes, and issue me a ''drive for work license''!
If anybody has any ideas, I sure would appreciate hearing them.

Assuming you did not voluntarily waive the right to a speedy trial, you or your lawyer should be demanding that the charges be dismissed. There is no need for you to be convicted if they can't bring your case to trial within the legal time limits, so don't plead guilty! Don't you have a public defender at least? A competent lawyer would be objecting to the case being rescheduled and demanding that it be dismissed.
