Legal Question in DUI Law in California
My boyfriend has gotten a DUI and a wet and wreck less. He is currently doing SWAP (sheriffs work alternative program). This last weekend he got into an argument with a police officer and got arrested for obstruction of justice (all he did was ask the cop a question) and a SWAP/probation violation. He is now booked in jail on a SWAP hold. The judge lifted the hold and told him if the SWAP officer will take him back, he can be released and continue doing his SWAP. When I called the sheriffs office they told me his case is in review. How long does it take for the officers to review his case and determine if he is able to get out of jail and continue doing his SWAP normally? We have been waiting for a couple days and it is almost Christmas. I would hate for him to miss his sons first christmas. Is there anything I can do to speed up the process?

I tell all callers, there is no way THEY can do anything. They are not his lawyer. They have no way of knowing if what they think is a great idea is what the client wants. Your boyfriend's ONLY source of help is his attorney. When I see a case where the attorney won't help after the person is sentenced, I know its either (a) public defender, or (b) discount attorney with office across the street from the jail. You do get what you pay for!
