Legal Question in DUI Law in California
My brother was charged with a DUI and his original court date was in December. But it was pushed back due to them not being able to find the blood test. And it has been set two more times with it being pushed back for the same reason. Is there a certain amount of time they have to charge him before they waive the charges or can they continue to keep moving the court date?

If it was a misdemeanor charge, they would generally have a year to file charges.

Your brother's lawyer should be pounding on the table demanding that the case be dismissed because your brother was denied the right to a speedy trial. He should not agree to any extensions of time.
