Legal Question in DUI Law in California

Changing penalty from volunteer work to a fine

I was found guilty of a Wet Reckless and was originally given a fine of $750.00. At that time I could not afford to pay so I asked my attorney to see if I could do community service instead. I have not been able to complete my community service and would like to know if it is possible to request to have the penalty reverted back to a fine. How would I go about doing this? I no longer have an attorney.

Heidi:

Thanks for your posting. Part of your answer really depends upon the personality of the judge, so it is difficult (and not allowed) for an attorney to guarantee or promise you a certain sentence.

However, if you have shown responsibility and good faith to the court by either making some payments, or doing community service, it normally is not a problem to request a conversion back to a fine. It helps if you can show the court that you will pay in full, so they won't have to keep dealing with this.

If you have done some of the community service, make sure it is credited towards your fine.

Thanks again, and if you have any questions or want more information, please feel free to email me or call my office toll free at 1-877-568-2977.

Best of luck!

Robert
