i was not charged for DUI. can DMV remove it off my record?

Even if the District Attorney did not charge you (and they have a year) you must have filed a request to contest the action at the California DMV or else the DMV will have a finding against you on your record. If that has happened, and the case is less than a year old, there is a procedure to have it overturned at the DMV, but you will need a lawyer to do so.
