Legal Question in DUI Law in California

i went to court for possesion of controlled substance but now they are trying to add a DUI charge. I was not driving, and they did not take my BAC at the station. i was released on bail on a felony possesion charge for 10,000. my PD was very rude and informed me that they were going to add DUI, this will be my 4th DUI, he also said that i was facing 6yrs in prison which i dont understand why, what should i do, should i fight it, what is the max time for a 4th DUI offence, can i ask for a continuance so i can get a lawyer??? please help ASAP!!!

I do not mean to be rude, but what do you think you should do ? You're facing state prison and your "Attorney" isn't helping you......so what should you do ? Well If I were in your situation, I'd be calling a very good lawyer in my area and try to retain him/her. Tomorrow, after 8:30. AM, begin calling and makeing appointments with at least 2 attorneys. A 4th DUI is indeed punishable by state prison time and I have no reason to doubt your PD when he says you could get 6 years. If I was facing 6 years I would not use a PD. Yes, you can ask for a continuance to hire a lawyer depending on how far along you are in the process. While the court is not going to go backwards in time just because you chose not to hire a lawyer before now, it sounds like you have nothing to lose by hiring a lawyer even at this late date. The lawyer you hire will need as much time as possible to prepare your case, and this is a serious case, so don't think you'll be able to hire a lawyer the day before your next court date and have a fully prepared lawyer. Start calling lawyers tomorrow morning.
