Legal Question in DUI Law in California
I'm just curious how, if at all, pending cases are affected when laws suddenly change? I'm referring specifically to a pending marijuana possession charge in light of the law changing here in California.

It depends whether we are talking baggies or boxcars. A baggie, they might forget the whole thing, especially if you make noise and demand a jury trial, which is what you should be doing (assuming less than an ounce and no significant priors). There are two law changes to be concerned with, the possible passage of Prop 19; and the new law making possession of less than 1 oz an infraction (effective 1/1/11). If they don't toss your whole case, maybe they will agree to reduce it to an infraction.
