first degree murder charges (187pc)
My son is being charged with an open count of murder 187. In short he went to a home with a gun (which he always carries ) He had an agrument over the phone with some people and went to talk about it. They were all talking calmly, when the discussion got heated. One of the visitors at the home grabbed the gun from my son who was sitting in the car still. They struggled with it, the victom slipped and fell, the gun went off. I dont see that being first degree murder. Our defense will be self defense and or accident and misfortune. Are there any books my son can read on this or better yet, case's that have won thier defense in this. Case law, I believe its called. Any helf or advise is welcome.

Self defense is sometimes a legitimate defense. However, prior to jumping to case law, all the facts and available evidence must be gathered so that one can have a very clear idea what the real issues are. In a case where your son is actually being charged with murder in the first, I would hire an attorney ASAP. THIS IS NOT A SITUATION WHERE ACTING WITHOUT COUNSEL IS PRACTICAL. IT'S VERY DANGEROUS!
