Do you automatically get drug tested after an accident?

Only if 1) the responding police officer suspects you are under the influence; 2) if you have a commercial driver's license and are driving a commercial vehicle; or 3) you are driving a company vehicle and your company has a post-incident drug testing policy.

No. You are drug tested only if a police officer comes to the scene and there is some indication that you are under the influence of alcohol or drugs.
