Legal Question in DUI Law in California

DUI and diversion agreements

my son is 21 in the marine corp and

got his first DUI. He thinks his best

option may be to plead no contest

and ask for a diversion agreement.

His worst consequence is that if

convicted, he cannot receive a

promotion in the USMC for a year

plus he was demoted for having

received the DUI. If he is able to get

the diversion and he completes the

requirements will the conviction be

removed? What is the best way to

learn about representing yourself in

court? He can't afford an attorney

and goes to court Sept. 4. Thank

you.

If you son has been offered diversion he is not charged with DUI, he is charged with a drug charge or some other crime that is eligible for diversion. If he is charged with a DUI there are several ways that a conviction may be avoided (win the case) or that probation may be kept to a minimum (if at all). A lawyer can help explain the options available to your son.

Your son needs an attorney. There is NO diversion for a DUI in California. There is no way he can get this removed without either knowing the law, or having a lawyer.

Your son should really try to hire a lawyer. There are long lasting consequences to your son's choices that will affect his career and life in and out of the military.
