DUI, Hit and run driver, borrowed vehicle

I was hit by a DUI driver that was fleeing from a hit in run a mile down the road. They were not insured, but the vehicle they borrowed is, through the legal owner. The driver went to jail for VC 23152(a), 21801 (a) 23153(a)(b) I am getting nothing but a run around from the insurance company. so far it has cost me almost $2,500 plus my vehicle was a total loss. I am bouncing checks left and right and am being evicted because I have not been able to pay all my rent. What can I do and do they have to compensate me for all my losses?
