Legal Question in DUI Law in California

dui, legal stop?

I was pulled over for a rolling stop last weekend. It had just started snowing and the streets were slick. When I tried to stop at a stop sign, I slid maybe a foot and came very close to a full stop. Once pulled over, the officer detected alcohol and the testing began. I blew .15 and it is a first offense.

I never received a ticket for the failure to stop at the sign. Does this matter in my case? Also, on my notice of stored vehicle slip, the office entered the towing company name and phone number. When I called that number, it was a number to an attorney. Is this grounds for anything in my case?

Also, my APS was not signed by any officer saying I was served with the APS, does that matter to the DMV as far as requesting a hearing and getting my license back?

Thanks.

You should request the DMV hearing as soon as possible, or request an extension of time. What you mention in your post does not matter to the DMV, but it might hold some weight with the court. Call an attorney to discuss. Good luck.
