Legal Question in DUI Law in California

dui for marijuana

i was pulled over for having my front windows tinted on my car. i admitted to drinking and smoking marijuana to the cop due to the pressure he was putting me in. i refused a breathalyzer so i was taken to the station for a blood test. i felt like i was getting picked on the whole time. i recently found out my blood alcohol level was 0.04%. what are my chances of fighting this off if i were to hire a lawyer?

Re: dui for marijuana

DUIs for MJ can be beaten, you will need to hire a lawyer. Your odds are very good since there is no quantitative level of MJ (for example there is a presumption that .08% blood alcohol=DUI). The fact that you actually admitted drinking and smoking to the police, or that you spoke to the police at all, is a strong indication that your judgment is too poor for you to be smoking or drinking. Go to YouTube and watch the video, Busted: A Citizen's Guide To Surviving Police Encounters. Then call a lawyer in your area well in advance of your court date.

If your driving and physical actions were not demonstrably impaired, you probably have a reasonable chance. A lawyer could tell you, after examining all the evidence. If money is an issue, you may qualify for free representation from the Public Defender (if in doubt, ask them). You can also, of course, represent yourself in fighting the case, although you should get a lawyer, if at all possible.
