Legal Question in DUI Law in California

Dui + mip

I got a DUI on 06/28/03 (BAC .08). I was camping one weekend, and my friends and I were all taking turns drinking from a beer bong. I was 19 years old at the time of the incident (06/12/04). The park ranger approached us as it was my turn to drink. After I noticed he was standing there with his flashlight pointed at me, he issued me with a citation for an MIP. Because of my previous record, what will my punishment be? I will have my license for about 2 weeks before I go to court for the MIP, will they take it back or will I be able to do other things to avoid this from happenning (i.e. community service, pay a fine, etc.)?

Dude. Drinking from the beer bong? That must taste like shit. Surely you could at least have gotten a fresh beer. I'm not optimistic about your license. It depends on the terms of your previous probation and whether or not the judge is having a bad day. I would be ready with a good (but true) story about how you need your license to drive your poor, old, sick Mom to the hospital for her kidney dialysis and how you have to drive to work every day in order to pay for it.
