Legal Question in DUI Law in California

My son was arrested for a DUI. At the time of arrest, my son had quit drinking about 1:00am and he left his friends house alittle before 5:00am, he was pulled over and was given the drunk test and passed. But because he had fallen asleep on the off ramp, he was take to to sub station, not arrested , therefore he was not given his rights. He was taken to the sub station at 5:00 am and released at 5:20. I picked him up at the station and he was fine. He blew a .12. zmy son is a class A truck driver and I wanted to know how we can save him from his license being taken away. I know that the DMV steps in and that the Court and DMV are separate entities. Please advise me what we can do for him.

He needs to retain an attorney to represent him at the dmv hearing and then in criminal court.
