Legal Question in DUI Law in California

My 18yr old son was stopped at a sobriety checkpoint in San Bernardino County. Passed all field tests but breath registered .06. He admitted to me that he only had 2 beers to drink because he wanted to stay sober to drive his girlfriend home. On the way to jail, police stopped to help out officers who had someone pulled over which led to a high speed chase. He stayed cuffed in back of car during intense chase which led to the police car running over their own spikes and flattening their own tires. My son was forced to sit in back of cop car while the tires were being changed. Is this legal? Is there something I can do? Now he will most likely lose his license and he wasn't unsafe to drive. 3 out of 4 policemen agreed they shouldn't arrest him, that he was ok to drive, but 1 didn't, so instead he was subject to a high speed chase which caused much more danger than allowing him to drive home. I am outraged and feel helpless. Do we have to tolerate this?
