Re: Failure to complete SB 38 Program

It is going to depend on the judge, how long ago the program was assigned, and whether he made any effort to complete the program. He most likely was assigned a 1 year suspended sentence if it was a second DUI. This means the judge could give him up to a year for the second DUI, and possibly an additional six months for the first DUI if he was still on probation.

You should consider calling my office immediately to get the program reassigned.
