Legal Question in DUI Law in California

False alcohol readings due to prescription drugs.

I was pulled over because I flashed my headlights at the traffic lights. I had just finished the last of my 2 1/2 beers. I was not intoxicated. I blew a 1.1. I had taken medication shortly before drinking. I took something my neighbor gave me for my toothache. Is there any alcohol/drug interactions known that would cause the breath test to go over? If not known,is there some person or place that could help me find the answer? If I were to be found inocent of the DUI, would I be able to get off on what they found in my purse that they took from my brother's car after they arrested me?

You need to ask a drug and alcohol expert this question. I am unaware of any pain killer that would increase the blood alcohol level. However some painkillers, especially codene and it derivatives, will enhance the effect of the alcohol on your ability to perform. If the stop was legal then anything found in the car would be admissable at a trial.

You should discuss the facts of your case with an attorney to determine if there are any defenses.
