Legal Question in DUI Law in California

Felony DUI what to expect

Lane 1 = Far Left Lane

I was traveling in lane 2, slightly overtaking cars in lane 1 and 3, speed about 65-70 mph

Chevy in lane 1 changed into lane 2 as I was passing and hit my left rear

Driver was mad and wanted my drivers license, then changed her mind and said she wanted to call the police

When fire trucks and ambulance arrived the driver was suddenly stricken with a dire need to be transported to the hospital. She apparently works at the hospital

2 witnesses in another car apparently told police that the collision was my fault

Police interviewed me and noticed Maryland drivers license. I told them that I maintained two residences and that Maryland was my primary

Police gave me a field sobriety test. After taking the breath test I was arrested for felony DUI.

Approximately 30 minutes later I took breath test at station. Results were .05

Charged at the station with Felony DUI and processed

What can I expect at arraignment? I dont have CA license but do have valid MD license. What can I expect from CA DMV? What are possible outcomes if other party was/was not injured?

Re: Felony DUI what to expect

The DMV should not take any action as your blood alcohol was under .08%. Therefor you did not violate VC 23152 (b).

You could be tried for driving under under the influence of alcohol. You need to hire an attorney immediately. You are facing a possible prison sentence. For the best defense you will need to hire a p.i. and an expert witness.
