Legal Question in DUI Law in California
Lying officer
A man was arrested on the side of the freeway for drunk driving, but he wasn't driving at the time of the arrest and the court threw the case out. The DMV still took the persons license for 30 days because an officer lied and said that the person told him he was driving. The officer's lie resulted in the person loosing his job because he drives for a living. Can the person who's license was taken sue the police department?

Re: Lying officer
The police generally enjoy wide immunity from being sued. It is unlikely that you will be successful unless you can prove that he committed perjury.
