Marijuana ''DUI''
My question is if my friend got pulled over and was given a citation for being under the influence and for possesion of .4 and was arrested and let go the same night, but confessed to the charges but was never read his right is that still a case?

The citation will be sent to the DA for further prosecution. After the substance taken by the police is analysized and determined to be an illicity substance charges will be filed.
If the police report shows extremely bad driving or feild sobriety tests the DA may file a complaint regardless of the results of the analysis of the substance taken by the police officer.
Your friend should contact an attorney as soon as possible and discuss his case.
