Legal Question in DUI Law in California

Minor In Possession

Last night I was at a party with some friends. I was walking inside to put down a drink that a friend had given me to set down, I walked inside to the house and put it on the counter and was about ready to go upstairs to the bathroom when someone grabbed me by the arm and pulled me outside. It was a cop and he wrote me a ticket for a mip. I have two questions regarding that. The first is, Is it legal for them to enter the house and pull me out like they did? I just didn't think they could prosecute me for it because they had no proof that I was even drinking and I didn't think it was legal for them to enter the house the way they did. And, if I can't fight it in court, how much do those tickets coast?

Re: Minor In Possession

You should discuss this with an attorney. Technically you were in possession of the liquor. However, there may be defenses to this charge that are not obvious. Only by talking to an attorney about the facts and circumstances of your case can you determine whether and what defenses you have.
