MIP in Michigan

I was walking to my dorm one

evening when I was stopped by a

police car. They asked me if I had

been drinking and I said yes. I had

consumed three beers that evening

but it wasn't long enough ago in the

evening for me to contest and say

that I hadn't. They didn't breathalyze

me or anything but they still gave

me an MIP. After I was given the

ticket, they gave me a ride to my

dorm. Do I have any grounds to fight

this? What should I plead at my

hearing?

You're under 21; the police asked you if you were drinking acohol which , for you, is illegal; you decided it would be foolish to lie and said yes.

Is there something about admitting to a crime and then being charged that you don't get?

Plead not quilty at your arraignment unless the magistrate alllows you a deferral under the MIP act. Otherwise, set it for pretrial and convince the prosecutor to allow the deferral.

Or, if you're uncomfortable with conducting your own defense, ask your parents to pay for a lawyer.
