Legal Question in DUI Law in California

Open container violation in Los Angeles (on the sidewalk, not in a car) LAMC 41.27 (h) I got a ticket for this. It was declared unconstitutional in the People v. Duran, 43 Cal. App. 4th Supp. 1. Does this mean, I can just fght it and win?
