Legal Question in DUI Law in California

penalties for 2/3rd offense?

My husband has 2 prior DUI convictions. 1st was over 10 yrs. ago. 2nd about 4 yrs ago. If he gets another DUI what could happen? Would it be treated as #2 DUI or #3 DUI? He still drinks and drives.

A dui conviction older than 10 years is not considered a prior. However, it will be a factor that can be considered by the judge at the time of sentencing. You should do everything you can to prevent his drinking and driving. He is putting himself and others at risk. All of your assets are also at risk.
