Legal Question in DUI Law in California
my question is this. i was arrested for driving with a bac of .08 or higher. fine. i was my third dui. but the court filed it as my first. i already went before a judge, was sentenced to 3 days in jail, which i already did. $1500 fine, state restitution, booking fees plus 3 months enrollment in dui school. can the court refile when it discovers it's mistake? or is it a none issue now?

Usually, with the court, it is a done issue. However, the DMV may pick it up and make you do a multi-offender program, and not a 1st offender program. If and when that occurs, you will need to go back to court, to have them change their order regarding the DMV. David Wallin
