Legal Question in DUI Law in California
Hi, I received a DUI about a month ago. I was planning on walking into court(without a lawyer) and deal with whatever happened because everyone told me that there is no way on earth to beat a DUI. BUT, when I went to the DMV hearing, The cop lied so much that I want to fight it now! There is a recording of my arrest, I'm trying to get that recording! Once I have that recording, then I can show everyone what a lying peace of **** the cop is! He lied about me requesting a breathalyzer when I asked for the blood test(REcorded). Lied about me burping, I didn't know at the time but if you have heart burn and burp, the breathalyzer doesnt read correctly. I knew the entire time I wasn't drunk! I blew a .09 and couldn't figure it out because I hadn't drank for hours and only had 4 beers throughout the entire day. Well, I was burping and the cops were YELLING at me to BLOW, BLOW, BLOW!!!! All recorded.
Anyways, Point; how can I get that recording? Thank you very much!

Your attorney can get the recording.
you need to subpoena the video recording.
and as you can see going in with an attorney always give you a better advantage been going on your own.
You can probably get the recording as part of discovery. With the facts you've described you need an attorney. An attorney will be able to get the recording.
