Legal Question in DUI Law in California
I have received my 3rd DUI in 3 years. Still on probation for 1st and 2nd. I totaled my motorcycle but did not hurt anyone in any of the DUI's. I have no job, money, family and suffer from alcoholism. I was sober for many years in AA but have been drinking for 3 years now. Will I go to prison or can I get sent to a rehabilitation center? I can't stop drinking.

The sentence you can expect will depend a lot on the facts of your case as well of how vigorously they choose to Prosecute. I would assume that three DUI's in 3 years will be treated fairly harshly (not to mention the Probation violations). You need to work very closely with the Attorney or Public Defender on your case. There are alternatives to jail, but they are never automatic and are sometimes hard to achieve. A lot will depend on the job your attorney can do with convincing the Court that jail is not the answer for your situation.
