Legal Question in DUI Law in California
Reserved restitution
A Friends mother was hit by another driver, who in turn was arrested for dui. The guy had no insurance. The judge sentenced him to 16 months and ordered ''reserved restitution''. No one has explained to her what exactly this ''reserved restitution'' is.
My question : What is ''reserved restitution''?

Re: Reserved restitution
The court has reserved the power to determine the amount of damages caused by the action of the dui driver. She should contact the district attorney's office and request assistance in filing her claim for damages. Damages would consist of the property damages, loss of income, medical expenses and compensation for pain and suffering.
The uninsured motorist coverage would pay for the medical expenses, loss of wages and pain and suffering. The uninsured insurance is through your friends mother's insurance company.
