What responsibility does the spouce bear?

My wife has been an alcoholic for 3+ years now. She is unable or unwilling to quit drinking despite 4 different rehab stays. I have struggled with keeping her from driving wile under the influence. She drives with my son in the vehicle (He has begun refusing to drive with her period now), and has recorded .14, and .16 respectfully at the outpatient classes following a recent discharge from the rehab facility. She has recorded blood alcohol levels greater than .45 and was alert and talking to the doctor. I asked her to leave, feeling there is no chance for her to recover and I must protect my son, and what is left of our finances. I usually find out she has driven drunk after the fact, and have called the police to no avail; I understand that they must �Catch� her driving. She just left the house, I know she is drunk, but she denied drinking. I called the police in hopes they pull her off the road before she kills someone. I am interviewing divorce and bankruptcy attorneys next week,

My question is:

What responsibility do I bear if she is found guilty of a DUI, or worse and accident?

If the vehicle is in your name or you provide the vehicle to her you could be liable to the injured party. As for her being guilty of dui your liability would the loss of your car that she is driving.
