Legal Question in DUI Law in California

Got really screwed at court even with lawyer rep

had 2 dui in 2 wks weeks!. There were separate court dates but judge consolidated the two. 1st stop was admittedly wrong by officer when questioed. was ''paced'' for approx 2/10 mile at 45mph in 40mph zone Officer thought 35mph. Judge could care less. 2nd stop for lingering 5 secs after light turned green. Then the blood results were (.24 and .25) but was proven there were no preservative in the tube (mucus liquid substance in tube prior to blood going in as opposed to it supposed to be a ''powder'' substance that the sheriffs lab sent the PD. So I was convicted of one giant DUI with BAC unknown. Got Jail, 18 months Program, over 2600.00 in fines and many thousands of dollars to the lawyer. Also the lawyer forgot to send photos to the DMV of the 40 mph zone sign so they DMV after the 3rd stay said forget it we don't have proof. Guilty. Now I can't drive for a year, at least, more fines to pay down the line and first time to jail at ''twin towers''....suicide is looking better all the time. Have three kids to support and breast cancer. Any suggestios for my stupidity (started AA on my own and haven't had a drink nor want to in over three months now)

Thank you for your posting.

You have some rights, including withdrawing your plea through a court motion, appealing your decisions with the DMV through a writ, or applying for a hardship license. I don't know the timing of your case, and timelines are important considering how many days in some cases you have to act to protect your rights. I would suggest calling or emailing specifics, with dates, to attorneys to have them give you a more specific opinion.

I hope this helps, but if there is anything else I can do, please email me at [email protected], or call my office toll free, at 1-877-568-2977.
