Legal Question in DUI Law in California

transporting alcohol

Hey. Last week I was driving with my friend who is 21. I was the one driving and he had a bottle of scotch on him. I didn't know this and I told him that we can't do that because I'm uner age. I can't transfer alcohol. He said as long as it's his and with him we can.

Whats the right answer here? Can I transfer alcohol with a 21 year old or older in the car even though I am not of age?

Re: transporting alcohol

Transporting alcohol in a motor vehicle is a misdemeanor. The driver is responsible for any open container of alcohol in the vehicle. You friend is not correct. The fact that you are under 21 makes the situation even worse for you. An adult could avoid problems by locking the open container in the trunk of the vehicle. That will not be enough for a minor. The alcohol must not be in the vehicle.
