Legal Question in DUI Law in California
Warrant for Failure to Appear after DUI conviction?
Many years ago (1985), after an unfortunate DUI conviction, I had to leave the state to find employment (I had lost my local job due to the arrest). I informed the program counselor of this impending absence (it would have been temporary) and requested that the court date be moved ahead, or else, postponed until after my return.
She advised me that the date could not be moved and that an arrest warrant for ''failure to appear'' would be issued if I missed the court date.
Notwithstanding this warning, I missed the court date, as I was still out of the state (and country) then.
My question is, what is the penalty for such an offense? Would said warrant still be in effect?

Re: Warrant for Failure to Appear after DUI conviction?
The warrant will last forever, and if you get stopped for a traffic ticket in Calfiornia, the cop CAN search the many warrant systems. If he does and if he finds a warrant, you can be arrested on that warrant at any time. Plus, you'll never get a CA driver's license until you finish the alcohol program. So there are some problems associated with your situation. In answer to your question about penalties, I would need to know much more than you state here to predict a possible penalty for your situation. You should consult a lawyer in the area where the DUI court was. Most criminal lawyers give free consultations. If your case is in Los Angeles, you're welcome to call me for a free consultation.
