Legal Question in Education Law in California
Gentlemen:
I was seeking a free advice and I please....
The case is person A and person B are married, and they have property. But then person a past away. Person B get married to another person, which is person C. Now person C is claiming that he can do anything he want to person B and he also claiming as the owner of the property of person B and her late husband, because he said that he is married to person B.
The question is: Is person C have the right in targeting the property of person B and her late husband?
1 Answer from Attorneys
California is a community property state, but all property owned by a person before they enter that marriage or inherited during the marriage is their separate, private property over which the other person has no power or right of ownership. So C only has a interest in property obtained by the community during the marriage.
It sounds like B should immediately file for divorce .
