Legal Question in Education Law in California
Pending Graduation Statue
I would like to know how to file a ''stay put'' for a due process. My son is do to graduates this summer, once this happens he will not be able to continue to receive the special education services he needs in order progress academically. I would like to know how to get the school district to provide outside services provider until my son reaches 22 and to not proceed to graduation.

Re: Pending Graduation Statue
You do not want to keep him from graduating . . .
I presume that your son has an IEP (Independent Education Plan) . . . If he does, then you need to request (in writing) that the IEP Team convene an ITP (Independent Transition Plan) which should be done annually beginning at age 14, as a separate meeting from the annual IEP team meeting. This is mandatory federal law for those disabled students who have an IEP.
The ITP will provide the process by which your son will "transition" to the world either via a job or further education beyond high school . . .
Do NOT request a Stay Put . . . Do NOT keep him from graduating . . . If you need further advice contact a parent advocate in your school district or contact an education lawyer . . . good luck to your son on achieving a milestone under the difficulties of his disability. Patty Lewis . . .
