Legal Question in Education Law in California

School responsible for stolen property?

My son had a very expensive graphing calculator stolen

out of his locker. When he was issued the locker, he

had to a sign form stating that he was responsible for

all lost or stolen property. I myself never saw the

form or gave my permission. After the theft, my son

learned that the school hadn't changed the locker

combinations in several years. This fact was not

disclosed prior to or at the time my son signed the

release form.

Can the school be held responsible for the stolen

calculator, as I never signed any release form, and

neither I nor my son knew of the school's negligence

in changing the loc

Re: School responsible for stolen property?

Good question. Why not file a small claims action, and see what a judge says. (Send a demand to the school first). It's a good possibility that the document your son signed is not valid, if he was under 18 when he signed it.
