Legal Question in Elder Law in California
False Accusations ( report )
On the nights my daughter works late, My father baby-sits my granson untill i arrive home ( I live with my father ). My daughter picks her son up in the morning. Last night when I arrived home everything was fine as usual and my daughter picked son up so I could go to work. As i was getting ready to leave for work, a sheriff deputy came to our home on a report that my father had beat my grandson the evening before. The deputy drove to my daughters home to check out the child and then appoligized for bothering all involved. I understand that it was necessary to investigate the accusation, what I am furious about is the FALSE accusation. Do I have any recourse to the accuser. I am totally devasted as is my father and entire family. Isnt making false reports a crime ? Thank you, Mary

of course you do. depending on the frequency and/or severity of the false reports, you could have standing for fraud, abuse of process, malicious prosecution, etc..
