Misfilled prescriptions

Is a pharmacy responsible for my damages if they give me a misfilled prescription?

Misfilled prescription errors

If you get a prescription drug from a pharmacy then the pharmacy owes you a duty to use reasonable care filling the prescription. If they don't use proper care and give you the wrong drug, or the right drug with an incorrect label, then they are responsible for any damages that arise from their error. The entire field in California is regulated by a series of statutes in the Business and Professions Code and the Health and Safety Code.
