Legal Question in Elder Law in California

My mom was in a board and care home and had a service where they delivered depends sanitary items to the home. When she passed away there was a $800 balance on the account. Am I as her daughter responsible to pay the balance? The company is threatening to take me to court over the bill. I told them I would pay as much as I could.

Unless you have an agreement with the board and care home that you would be responsible for your mother's care costs or you were a co-signer or guarantor of any contract your mother made with them, you are not responsible for the balance due. If your mother estate will be probated, the board and care home should file a creditor's claim with the estate's administrator or executor instead of harassing you. If your mother estate doesn't require probating, the facility still would need to contact the executor/administrator regarding payment.
